There is a case pending in the Central Administrative Tribunal or CAT against the appointment of the Regional Censor Officer DN Sreenivasappa according to sources. The case has been filed by none other than former Regional Censor Officer Nagendra Swamy.
Sources tell Chitraloka that the case has been running for several months now. Swamy was the RCO in a term before another censor officer Natasha. According to sources when the central government department called for qualified central government officer to apply for the post, three central government officers applied for this. This included Nagendra Swamy and Sreenivasappa. Another woman officer had also applied. The woman officer however did not attend the selection meeting. Sources say that without calling for an interview of the other two candidates Srinivasappa was selected as the censor officer. This is the allegation made before the CAT by Swamy sources told Chitraloka. CAT is yet to decide on the case and the verdict is expected any time.

ಕರ್ನಾಟಕದ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ ಅಧಿಕಾರಿಗಳು, ಇಂಥಾದ್ದೊಂದು ಪ್ರಮಾಣಪತ್ರಕ್ಕೆ ಚಿತ್ರದ ನಿರ್ಮಾಪಕರಿಂದ ಸಹಿ ಹಾಕಿಸಿಕೊಳ್ಳುತ್ತಿದ್ದಾರೆ. ಇದು ಸೆಂಟ್ರಲ್ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ನ ಅಧಿಕೃತ ಪ್ರಕ್ರಿಯೆ. ಆದರೆ, ಇಲ್ಲಿ ಕರ್ನಾಟಕ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ ಅಧಿಕಾರಿಗಳು ಒಂದು ಪ್ರಮಾದ ಎಸಗಿದ್ದಾರೆ.
ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ನಿರ್ಬಂಧ ಕಾನೂನಿನಲ್ಲೇ ಇಲ್ಲ..!
ಸಮಸ್ಯೆ ಇರುವುದು ಇಲ್ಲೇ ಏಕೆಂದರೆ, ಸಿನಿಮಾಟೋಗ್ರಫಿ ಕಾಯ್ದೆ ಪ್ರಕಾರ, ಸೆನ್ಸಾರ್ ಆಗದ ದೃಶ್ಯ, ಪ್ರೋಮೋ ಅಥವಾ ಹಾಡುಗಳನ್ನು ಪ್ರಸಾರ ಮಾಡುವ ಹಾಗಿಲ್ಲ. ಆದರೆ, ಆ ಕಾಯ್ದೆಯಲ್ಲಿ ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ಇಲ್ಲವೇ ಇಲ್ಲ. ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ಎನ್ನುವುದು ವೈಯಕ್ತಿಕ ಮಾಧ್ಯಮವಾಗಿರುವ ಕಾರಣ ಹಾಗೂ ಕಾಯ್ದೆ ಜಾರಿಗೆ ಬಂದಾಗ ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ಕಲ್ಪನೆಯೇ ಇಲ್ಲದ ಕಾರಣದಿಂದ ಕಾಯ್ದೆಯಲ್ಲಿ ಸೋಷಿಯಲ್ ಮೀಡಿಯಾವನ್ನು ಸೇರಿಸಿಯೇ ಇಲ್ಲ. ಹೀಗಿದ್ದರೂ, ಕರ್ನಾಟಕದ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ ಅಧಿಕಾರಿಗಳು ಕಾನೂನು ಪುಸ್ತಕದಲ್ಲಿಯೇ ಇಲ್ಲದ ಕಾನೂನನ್ನು ಚಿತ್ರ ನಿರ್ಮಾಪಕರ ಮೇಲೆ ಹೇರಲು ಹೊರಟಿದ್ದಾರೆ.
ಅಂದಹಾಗೆ ಕೇಂದ್ರ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ನ ಪ್ರಮಾಣ ಪತ್ರದಲ್ಲಿ ಕೂಡಾ ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ಎಂಬ ಪದ ಇಲ್ಲ. ಚಿತ್ರಲೋಕ ತಂಡ, ಸಿಬಿಎಫ್ಸಿ ಇಂಡಿಯಾದ ಎಲ್ಲ ಮಾಹಿತಿಗಳನ್ನೂ ಜಾಲಾಡಿದಾಗ ಕೂಡಾ ಅಲ್ಲಿ ಸೋಷಿಯಲ್ ಮೀಡಿಯಾ ಎಂಬ ಪದವೂ ಇಲ್ಲ ಎನ್ನುವುದು ಗೊತ್ತಾಗಿದೆ. ಕಳೆದ 2 ತಿಂಗಳಿಂದ ಪ್ರಾದೇಶಿಕ ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ ಅಧಿಕಾರಿಯಾದ ಶ್ರೀನಿವಾಸಪ್ಪ, ಈ ರೀತಿಯ ಅಫಿಡವಿಟ್ಗೆ ಸಹಿ ಹಾಕಿಸಿಕೊಳ್ಳುತ್ತಿದ್ದಾರೆ.
ಇಲ್ಲದ ಕಾನೂನನ್ನು ಪ್ರಾದೇಶಿಕ ಚಿತ್ರಗಳ ಮೇಲಷ್ಟೇ ಹೇರುತ್ತಿರುವುದು ಏಕೆ..? ಇದರಿಂದ ಪ್ರಾದೇಶಿಕ ಚಿತ್ರಗಳಿಗೆ, ಅದರಲ್ಲೂ ಕನ್ನಡ ಚಿತ್ರಗಳಿಗೆ ಸಮಸ್ಯೆಯಲ್ಲವೇ..? ಕಾನೂನು ಪುಸ್ತಕದಲ್ಲಿಯೇ ಇಲ್ಲದ ಕಾನೂನನ್ನು ಹೇರುವುದು ಕಾನೂನು ಬಾಹಿರವಲ್ಲವೇ..? ಹಿಂಬಾಗಿಲಿನಲ್ಲಿ ಬರುತ್ತಿರುವ ಇಂಥ ‘ಅದೃಶ್ಯ ಕಾನೂನು’ ಮುಂದಿನ ದಿನಗಳಲ್ಲಿ ಯಾವ ಸ್ವರೂಪ ಪಡೆದುಕೊಳ್ಳಬಹುದು. ? ಸೆನ್ಸಾರ್ ಬೋರ್ಡ್ ಅಧಿಕಾರಿಗಳು ಇದಕ್ಕೆ ಉತ್ತರಿಸುವರೇ..?
In Darshan's next film after Kurukshetra, which has been named Wodeyar, he is playing the role of a boxer. Pavan Wadeeyar is writing the script and dialogues for the film and the shooting is likely to commence in December or January.
Darshan plays the role of a professional boxer in the film. Darshan will undergo training in professional boxing for the film. The film is produced by Sandesh Nagaraj who is close to the actor. Boxing and some south-east Asian martial arts will be a major attraction in the film in which Darshan's character is named Wodeyar.
According to sources Pavan Wadeeyar is almost complete with the script and dialogue writing and a final version will be presented to the producer and Darshan in a few days.
In a surprising and strange development the Central Board of Film Certification is moving ahead to censor the film content on social media. As everyone knows making a movie is one of the toughest task and to release it is another big struggle. Now the CBFC is turning out to be the bigger problem than making and releasing the film. It is attacking film makers with a censor scissor for social media.
Recently the Censor process was made online. Earlier it required about 40 days for the censor certificate to be obtained and now the time limits set down for various process of certificates is 68 days. As per this, even if the movie producer completes the shooting well in time he has to wait for 68 days to get the certificate. Now what happens to the film makers who have to submit the films for festivals or for some award and completes the film in November and want to get certificate by December? He will have to submit the film for the next year's awards and next year's festival!
Moreover where is our regional censor office heading? When a producer applies for the censor he has to give some affidavits to the Censor office. From last two months our Regional censor officer Srinivasappa is taking an affidavit in the following words
"That I have produced Kannada Digital Feature film ..... I hereby certify that no part of the film promos/sons relating to the film ...... Kannada feature, not certified by Central Board of Film Certification has been telecast on any broad casting television channel, or Social media and i also undertake that in future also I will be telecast only the certified songs sequences promos / film programmes on TV Channels."
One should observe the word Social Media in the Affidavit format given by the regional censor officer. Chitraloka searched the entire CBFCINDIA guidelines and nowhere we could find details or even a word about requirement of an affidavit let alone certificate for Social Media.
Regarding this Chitraloka contacted the earlier regional censor officer Mr Nagendra Swamy. He said that there are guidelines for film certification only. "As per cinematography act any movie which is screened in theatres censor certificate is required and as per the Cable Television Network Act 1995, any film material which has to be shown in the Television need censor. But for Online or Social Media there is no guidelines for censor. I am surprised by your words that they are taking an Affidavit mentioning about social media. This is not correct."
The fight over the film title Leader has gone before a court in Bengaluru. But if you look at judgement by the high courts and even the Supreme Court over the last few years it is clear that you cannot have a copyright on the title of any work, including films, books and music albums. There is copyright on the work itself but not on the titles.
The most famous case was two years ago when a writer challenged the use of the Hindi film title Desi Boyz. He claimed that it was infringing on his copyright as he had written a script called Desi Boys and shown it to the film maker. But the Supreme Court ruled (CRIMINAL APPEAL No. 258 OF 2013) that "A title does not qualify for being described as work". Further the court said that the words Desi and Boys were commonly used in spoken language and there cannot be copyright on it. So will there be copyright on words 'Mass' or 'Leader'. It cannot be.
There was another case involving Tamil director A.R. Murugadoss. In this case the Madras High Court ruled that there cannot be any copyright on the words like Raja and Rani. The film's title was Raja Rani.
The only case that can stand scrutiny is if one title is passing off as another. If the makers of Mass Leader are trying to sell their film as if it is the film Leader then it can be a case. But here it is Shivarajkumar starrer Mass Leader that is complete and it cannot be passed off as a film that is not even made.
