The
court order has been issued on Karnataka Film Chamber
of Commerce President S.Ramesh on 31st March. The complainant
in this case is Kannada Film Producers Association President
Basanthkumar Patil.
ORDER
OF THE COURT for the Case No. 29186/99
The
accused is convicted u/s 255 (2) Cr.P.C of the offence
punishable u/s 138 of the N.I Act and he is sentenced
to pay a fine of Rs. 7.25 lakshs or in default to undergo
simple imprisonment for four (4) months.
Out
of the fine amount, an amount of Rs. 7 lakhs shall be
paid to the complainant as compensation.

The
order clearly indicates that for the bounce of three cheques
given by S.Ramesh the accused has to stay in the prison
for 26 months or that he has to remit Rs.41 lakhs to Basanthkumar
Patil and Rs.1.45 lakhs to court.
The
case dates back to the Kannada film ‘Cheluva’ time in
1990’s. On 21st November 1995 Basanthkumar Patil had given
the finance on negative rights to S.Ramesh the producer
of ‘Cheluva’. But the clever S.Ramesh without the knowledge
of his financier sold the rights of BKT to Sandesh Nagaraj
and R.F.Manikchand. Although the muddle was sorted out
by release of the film jointly by all the three, S.Ramesh
could not recover at the box office and he was asked to
submit the balance of amount by Basanthkumar Patil.
S.Ramesh
at this time approached the former KFCC Presidents K.V.Gupta,
K.C.N.Chandrasekhar, R.Lakshman and C.V.L.Sastry for help.
At a meeting it was agreed that Ramesh has to pay only
Rs.8 lakhs for Basanthkumar Patil. S.Ramesh on the advice
of seniors issued 3 cheques amounting to that amount.
The cheques kicked back. At this point Basanthkumar Patil
filed a complaint of cheating. He also submitted the actual
papers of his transaction with S.Ramesh setting aside
the Rs.8 lakh issue. Failing to settle the amount the
order was passed on 31st March ordering S.Ramesh to pay
the above said amount.
All
is not well already at the KFCC. The office is under construction
and struggling to come up.
The
arrest of sitting President of KFCC S.Ramesh is a bad
patch in the history of Kannada cinema.
